Terms of Sale
Show SidebarBy purchasing products from J.W. Speaker Corporation, you hereby agree to J.W. Speaker Corporation’s “Terms of Sale.”
SECURITY
To the extent reasonably possible, strict security measures are enforced to protect personal information. Secure Sockets Layering (SSL 128-bit) is used to encrypt transmitted information during a purchase. SSL technology is the industry standard for secure online transactions. Extra safeguards are in place to protect credit card information. Credit card information is stored in a restricted database on a secured server behind a firewall. Credit card information is deleted/destroyed 30 days from the original date of purchase.
RETURN POLICY
If you wish to return a J.W. Speaker product, please contact the authorized J.W. Speaker retailer where you purchased it. Returns may be subject to the dealer’s policies and procedures.
AFTERMARKET PRODUCT WARRANTY
If you have issues with a J.W. Speaker product, we strongly recommend that you: (1) troubleshoot your light and (2) contact the authorized retailer where you purchased it.
If the lamps were included as a standard product on a vehicle that you purchased, please contact the vehicle manufacturer (OEM) for warranty concerns. Only OEM vehicle manufacturers and authorized J.W. Speaker dealers and distributors may contact us directly for warranty claims.
1.0 WARRANTY SCOPE AND TERMS J.W. Speaker Corporation provides warranty coverage for its products against defects in materials, components and workmanship. There is no express or implied coverage for any other costs, such as labor costs, travel, incidentals and collateral damage. This warranty applies to the original purchaser only and is not transferable. Coverage extends only to replacing a defective part. Exceptions and exclusions are referenced in Sections 2.0 and 3.0. |

1.1 LED Products All LED products sold by J.W. Speaker provide a five (5) year limited warranty, with exceptions and exclusions summarized in Sections 2.0 and 3.0. |

1.2 Bulb-based, Legacy and Non-Lighting Products All bulb-based, legacy and non-lighting products, including incandescent, halogen and HID lights, as well as electronic components, harnesses, mounting equipment and accessories not included with LED products provide a one (1) year warranty. Light bulbs are specifically excluded from warranty coverage. |

2.0 LED PRODUCT EXCEPTIONS The following exceptions apply to J.W. Speaker standard warranty: |

• All Heated Lights: Two (2) years • Model 8770 Locomotive Lamps: Four (4) years or 30,000 hours • Non-Heated EVO J3 Lights: Three (3) years • Model Trail 6 Flash, Sport, and Pro: Three (3) years • Model 210 Solar Lights: One (1) year•Model 9600 POD Light: Heated Two (2) years, Non-Heated Three (3) years |

3.0 WARRANTY EXCLUSIONS J.W. Speaker’s Warranty Policy does not allow for claims resulting from the following conditions: |

• Abuse, neglect and damage • Modifications and alterations • Improper installation • Chemical exposure (e.g. cleaning solutions) • Voltage spikes, transients and over-voltage beyond rated specifications • Naturally occurring phenomena such as condensation, corrosion and UV degradation • Wear and tear, including damage from road debris and resultant lens degradationVisit www.jwspeaker.com/warranty-exclusions for more details. |

4.0 WARRANTY CLAIM PROCESS This Warranty Policy applies ONLY to the customers who purchased products directly from J.W. Speaker. Claims from end customers must be routed to the source where purchased, and processed with them to obtain a Returned Materials Authorization (RMA). WARRANTY PROCESS
If you have issues with a J.W. Speaker product, we strongly recommend that you: (1) troubleshoot your light and (2) contact the authorized retailer where you purchased it.
End Customers
End customers MUST initiate a warranty claim with the authorized J.W. Speaker dealer where they purchased the product. J.W. Speaker Corporation does not process end customer warranty claims.
Dealers
If the claim is valid, the dealer must submit a warranty claim form to their distributor, NOT to J.W. Speaker, and ask them to obtain a Returned Materials Authorization (RMA) number in order to proceed.
Distributors
Requests for warranty items will require a return of your product(s) for inspection prior to credit authorization to your account. Learn how to submit your RMAs here.
MAP POLICY
J.W. Speaker Corporation has built a strong reputation over many years by providing high- quality, premium engineered lighting solutions to the automotive aftermarket. However, external advertising that undercuts our products’ market prices has been shown to negatively affect the goodwill of our brand, damaging our reputation in the process. Therefore, in order to protect our brand and support distributors and re-sellers who have made investments in inventories and in marketing and promoting our products, we’ve established a Minimum Advertised Price Policy (the “MAP Policy”). This unilateral MAP Policy applies to J.W. Speaker products purchased and sold by U.S.-based automotive re-sellers. Click here to review the full policy.
VIOLATIONS OF MAP POLICY
Failure to abide by this MAP Policy will result in such consequences as J.W. Speaker may determine in its sole discretion. These consequences may include, without limitation, ineligibility to participate in advertising and sales promotions, loss of access to any discounts or rebates offered by J.W. Speaker, loss of right to use marketing funds or co-op advertising funds, loss of ability to participate in J.W. Speaker programs, loss of access to all or part of a J.W. Speaker product line, and suspension or termination of re-seller’s status as an authorized re-seller of J.W. Speaker products. J.W. Speaker may provide a warning for a first violation, but is not required to do so.
UNAUTHORIZED DEALERS
J.W. Speaker’s focus has always been to provide innovative, market-driven products and exceptional customer care for all our customers. As such, we continually work with distribution partners to ensure that a high level of customer care is delivered all the way to the end customer. Since our distributors support over 40,000 dealers worldwide, this can sometimes be a challenge when rogue dealers use channels such as Amazon and eBay. To this end, we are committed to being vigilant in flagging these companies and identifying them as not authorized to sell our products. Dealers who fail to provide exceptional customer care, sell counterfeit products and/or violate agreements shall NOT be tolerated and subsequent remedies shall be taken. The list below reflects companies who are NOT authorized to sell our products nor are they entitled to participate in our warranty program.

SHIPPING & TAX INFORMATION
Shipping & Handling Information:
- All orders are shipped via FedEx.
- Please allow 6-10 business days for shipment.
Tax Information: A 5.6% sales tax applies to all Wisconsin orders.
DELAY IN SHIPMENT
Product delivery dates are approximate. J.W. Speaker Corporation will not be liable or in breach of agreement for delivery within a reasonable time following the dates provided. In the event of a delay in shipment, J.W. Speaker Corporation will send notification. J.W. Speaker Corporation is not liable for delays in delivery or performance resulting from incorrectly provided information. Nor is J.W. Speaker Corporation liable for delays caused by circumstances or causes beyond its reasonable control.
LIMITATION OF LIABILITY
J.W. Speaker Corporation is not responsible or liable for any form of direct, punitive, special, incidental, consequential, or any indirect damages of any kind or type, whether such damages are based in a claim oftort, warranty, contract, strict liability or other causes of action, arising directly or indirectly from or in connection with any J.W. Speaker Corporation product or its use.
INDEMNIFICATION
Customers agree to indemnify, defend and hold J.W. Speaker Corporation (including its officers, affiliates, directors, advisors, members, representatives and agents) harmless from any claims damages, costs andexpenses (including, but not limited to, attorneys’ fees) arising from or related to the misuse of J.W. Speaker Corporation’s products.
INTERPRETATION & DISPUTES
This Agreement is governed by the laws of the United States and the State of Wisconsin, without regard to any conflict of laws provisions. The provisions of the United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. Venue for any dispute arising under this Agreement shall be proper exclusively in Washington County, Wisconsin. In the event of any dispute the prevailing party will be entitled to recovery of its reasonable attorneys’ fees and costs.
Any controversy or dispute arising out of or relating to this Agreement must be resolved by binding arbitration before a sole arbitrator. If the parties are unable to agree on an arbitrator within 30 calendar days of a written request for arbitration, an arbitrator will be selected pursuant to the rules and procedures of the American Arbitration Association (AAA). Either party may seek from any court interim or provisional relief that is necessary to protect the rights or property of that party, pending the appointment of the arbitrator or pending the arbitrator’s determination of the merits of the controversy.
POLICY MODIFICATIONS AND AMENDMENTS
J.W. Speaker Corporation reserves the right to modify or amend this policy at any time. Updates will be posted on this website. Changes will be effective immediately upon their posting. Online modifications and amendments supersede any printed version/copy of these policies, terms and conditions.
